Procurement Law

Procurement and tendering are professions of their own. The lawyers of KienhuisHoving, specialized in procurement law, will be glad to assist you.

A team of specialists is working with European and national procurement law every day. We advise and assist both contracting authorities and tenderers in almost all sectors. Examples are the building, project development, architecture, health care, IT, waste collection and processing, cleaning, transport services, office and project furnishing and payrolling.

Advice and assistance
You can contact us for all your questions in the field of procurement law. We can inform you about the interpretation and application of the European procurement directives, the Public Procurement Act 2012, the Guidebook on Proportionality and the ARW 2012.

We advise contracting authorities, among others, on whether a project or a contract is mandatory for procurement law and which processes can be followed. Subsequently, we can assist you in the guidance of the procurement process. Sometimes a tender may be better avoided. Together with you, we would like to think about all possibilities.

Tendering takes time, money and energy, but may bring you a lot of benefits. It is important to model your tender so that your chances are optimized. We would like to think along with you on this.

Litigation
We have extensive experience in conducting litigation (including summary proceedings) before the courts and complaint proceedings in the Commission of Procurement Experts (“Commissie van Aanbestedingsexperts”). If a procurement leads to litigation or complaint proceedings, you will know you are strengthened by the knowledge and experience of our specialists in procurement law.
