Procurement and Competition law
The Competition Law practice group operates in all areas of its field, including:
Competition regulation: the practice group assists clients in cartel investigations by the European Commission and the Netherlands Authority for Consumers and Markets (ACM, formerly NMa). The practice group also offers its clients compliance programs aimed at safeguarding compliance with competition rules. In addition to advising on horizontal and vertical agreements between businesses, such as distribution, franchise and agency agreements, the practice group is also involved in questions regarding abuse of a position of economic power. The practice group regularly litigates on these subjects before administrative courts and civil courts.
Merger control: with regard to mergers and acquisitions the practice group is involved in concentration notifications to the European Commission or the Netherlands Authority for Consumers and Markets (ACM). It also advises on related subjects, such as non-compete clauses between buyers and sellers and due diligence investigations.
State aid: the practice group regularly advises on state aid aspects in the context of e.g. real estate projects, public-private partnerships (PPP) and tendering procedures. It is also involved in civil law and administrative law procedures and complaints procedures before the European Commission.
Energy law: the practice group advises clients on the application of the Electricity Act 1998 and the Gas Act. It represents clients in dispute proceedings before the Netherlands Authority for Consumers and Markets (ACM) and in proceedings before administrative courts and civil courts.
