One of the key tasks of corporate lawyers relates to risk reduction. Legal risk management is therefore also the starting point at various levels for determining the appropriate legal interventions aimed at reducing risks. This chapter explains how risk analysis techniques can aid in making and accounting for such legal choices. In the process, a distinction is made between choices concerning the legal structuring of companies (‘organisational risk’), legal choices made in the formation of contracts with suppliers (‘transaction risk’) and legal choices made in the contract realisation phase (‘realisation risk’). All of the above is illustrated with examples from the perspective of IT procurement.
